Frequently Asked Questions

I want an update on my case:

Please review the welcome video that was sent to you in our first email and in response to your prior email. If you haven’t heard from us, please be assured we are working on your case and there have not been any new developments thus far. As soon as we hear anything we will update you. These cases take time as we are probably awaiting a response from the other side.

Do I have to pay all the fees on the confirmation letter?

You are responsible for the legal fees outlined in your confirmation letter. You have given us permission to charge your debit or credit card on the dates outlined in the letter.

Please explain what all the other options entail.

You do not need to worry about the other options. When you talk to your attorney if another option needs to be selected, we will go through it then.

When do I have to pay the 1/3rd legal fee?

Once the other side has agreed to an amount, we will let you know what it is and how to pay it

How much will the 1/3rd legal fee be?

We will have an amount once we know the settlement amount.

How much are my monthly payments going to be?

We will only know the amount once we finish the case.

Will the fees I am paying you be deducted from my total lawsuit?

You are paying us for our work and time to help you get this worked out correctly. The amount you owe the other side is separate.

I gave you my credit card information yesterday, but I am still getting calls – why is that?

It will take a few days for them to process our letter of representation. You do not need to answer or if you do, tell them you are represented by Rodier Law Offices and they cal call us at 614-224-7754 if they need to speak to someone.

I gave you my credit card information last week – please give me an update on my case (case isn’t set to open for another week).

The email I received says that I am responsible for attending hearings but I was told I wouldn’t have to attend – which is the truth? Do I need to attend court?

You do not need to attend unless your attorney notifies you that your appearance is required, which is very rare.

What if I do not know how much I owe to the plaintiff?

The attorney will determine the amount of the suit when the claim is reviewed. You will be charged for a case under $5,000, but that is subject to change if the debt owed is over that.

The answer you filed says I don't owe this debt but that is not what I told you – am I going to go to jail for lying?

We are not lying. You will not go to jail. We are setting out our defenses for the court.

My payment processed this morning – please give me an update on my case.

Now that we have processed your payment, we are opening your case and preparing the legal documents for filing in court. You will receive a copy of everything once that is completed. It will then take some time to hear back from the opposing side. As soon as we have any information, we will contact you.

What do I do if I received papers from the court or opposing counsel?

Please fax or email a copy to us at 614-224-7760 or rodierlaw309@gmail.com. Also be sure to retain a copy for yourself.

I need a new initial payment date.

It is sometimes difficult for us to get the opposing side to change the first date. Please do you best to meet that obligation. If it is absolutely impossible, please send us an email at help@rodierlaw.com explaining why and giving us a date. We will do our very best to assist you and contact you to update you.

Can I make payments online or over the phone?

Please review the last documents we you sent and contact the place we told you to send your payment. They will let you know if you can pay online or over the phone.

I made my lump sum payment yesterday, why haven't I received my dismissal?

It will take a few weeks for the courts to process everything. As soon as it is ready you will receive it.

I made my settlement payment – did you receive it?

We do not process your settlement payment. That is done by the opposing side. You will need to contact them from the information we sent you in your settlement email and ask them this.

I went online to make my payment and it says I owe the original amount, but you told me it had been reduced.

It takes a bit of time for them to change that

Why did I hire you, I could have negotiated this myself?

You hired us to make sure all the legal documents were written and processed correctly and negotiate a settlement for you. We have over 33 years of experience and our expertise will ensure that you have completed all the requirements to make sure you are fully taken care of in this case.

I can't print from my email, can you please mail the settlement documents to me?

Unfortunately due to the fact that the mail is no longer reliable and the cost incurred to do this we would have to charge you a fee to mail the documents to you. If you would still like us to do so , there will be a $5 fee. If you would like us to proceed with this option, please email us at
help@rodierlaw.com and let us know we can charge your card on file for the fee. PLEASE DO NOT SEND ANY CREDIT CARD INFORMATION IN AN EMAIL.

I need to know my current balance – I paid you to handle this case and it is your responsibility to get this information for me.

We would love to get this information, but unfortunately we do not have any access to it. Please call the place you have been making payment to, which is in the settlement email we sent you, and they will be able to provide that information. We have already advised them that they have permission to speak to you. However, if they will still not speak to you, please email us at help@rodierlaw.com and we will send them another permission to speak with you letter.

I received garnishment papers – what did you do for me?

We prepared all the papers for the court and negotiated your settlement. We prepared all the settlement documents for the agreement. You agreed to the terms of the settlement and were required to make you payments in a timely manner. You have received a garnishment because you broke that agreement and haven’t made your payments. We would be happy to assist you in renegotiating the agreement but would need to charge an additional fee. Please email us at help@rodierlaw.com if you would like us to proceed with a renegotiation.

I paid this off last week – when will I get proof that this is paid in full (MPP cases).

The opposing side will take a few weeks to process the final payment and get you the release. If you haven’t received it in 6 weeks please email help@rodierlaw.com so we can follow up.

I called to make my payment but they said they can’t talk to me or I need permission to speak to the opposing council:

OPL will not speak with me regarding my garnishment orders:

We are happy to reopen you case for a fee of $xxx and help you work out a solution. If you do not want to reopen your case, we would be happy to send a notice to the opposing counsel that we no longer represent you and then they will speak to you. Please email help@rodierlaw.com with the option you prefer.

Is this a criminal case?

This is a civil case. This is not a criminal case. 

Can I go to jail?

There is no criminal liability or jail time on a civil case matter. However, there are exceptions for income tax and child support. Depending on specific state rules, court orders that are not complied with could lead to a contempt order which may lead to a jail penalty.
